مدآپ را چه کسی اداره می‌کند

مدآپ (modeup.co) را بنیان‌گذارش، فرنوش خانی، شخص حقیقی ساکن ترکیه، اداره می‌کند. او «مسئول داده‌ها»ی تو است. هر سؤال یا درخواستی درباره‌ی اطلاعاتت: [email protected]

چه اطلاعاتی جمع می‌کنیم

اطلاعات حساب: نام، ایمیل و شناسه‌ی گوگل وقتی با گوگل وارد می‌شوی، نام کاربری، و آیدی اینستاگرام اگر خودت بدهی.
پاسخ‌ها و نتیجه‌ی کوییزها و سلیقه‌ای که انتخاب می‌کنی.
پیام‌هایی که به استایلیست هوشمند می‌فرستی و عکس‌هایی که خودت بارگذاری می‌کنی (لباس، استایل یا عکس خودت).
چیزهایی که استایلیست از گفت‌وگوها درباره‌ی سلیقه‌ات به خاطر می‌سپارد.
شماره‌ی موبایل، فقط اگر روزی با شماره (کد واتس‌اپ) وارد شوی.
داده‌ی فنی: نوع دستگاه و مرورگر، آدرس IP، و زمان استفاده.

برای چه استفاده می‌کنیم

برای اجرای خودِ سرویس: ساختن حساب، نشان دادن نتیجه‌ی کوییز، و دادن پیشنهاد استایل شخصی به تو.
برای امنیت و جلوگیری از سوءاستفاده، و برای رعایت سقف پیام رایگان.
اطلاعاتت را نمی‌فروشیم، برای تبلیغ هدفمند استفاده نمی‌کنیم، و ابزار ردیابی تبلیغاتی نداریم.

مبنای قانونی

بیشتر پردازش‌ها برای اجرای سرویسی است که خودت درخواست کرده‌ای (قرارداد). عکس‌های خودت و شماره‌ی تلفن را فقط با رضایت صریح خودت پردازش می‌کنیم و هر وقت بخواهی می‌توانی رضایتت را پس بگیری. امنیت سرویس بر پایه‌ی منافع مشروع است.

عکس‌های تو

عکس‌ها فقط برای تحلیل لباس و استایل و پاسخ به همان درخواست استفاده می‌شوند. از آن‌ها برای شناسایی چهره یا هویت استفاده نمی‌کنیم و خودمان از آن‌ها برای آموزش مدل هوش مصنوعی استفاده نمی‌کنیم. عکس کس دیگری را بدون اجازه‌ی او نفرست.

هوش مصنوعی

استایلیست مدآپ یک هوش مصنوعی است، نه یک انسان. برای پاسخ دادن، پیام‌ها و عکس‌هایت از طریق OpenRouter به یک مدل هوش مصنوعی (مثلاً از OpenAI یا Google) فرستاده می‌شود. پاسخ‌ها ممکن است اشتباه باشند. همیشه خودت تصمیم بگیر.

با چه کسانی به اشتراک می‌گذاریم

فقط با سرویس‌هایی که مدآپ را اجرا می‌کنند و فقط به اندازه‌ی لازم:
Supabase: پایگاه داده، ورود و نگهداری عکس‌ها
Cloudflare: میزبانی سایت و امنیت
OpenRouter و ارائه‌دهندگان مدل (OpenAI، Google): تولید پاسخ و تحلیل عکس
Serper: جست‌وجوی لینک خرید، فقط متن جست‌وجو بدون هویت تو
Lemon Squeezy: پرداخت و فاکتور خرید بسته‌ی پیام. اطلاعات کارت بانکی‌ات را مدآپ هیچ‌وقت نمی‌بیند
Google: ورود با حساب گوگل
Resend: فرستادن ایمیل
Twilio و Meta (واتس‌اپ): فرستادن کد ورود، فقط وقتی ورود با شماره فعال شود
اگر قانون ما را مجبور کند، ممکن است اطلاعات را به مقام رسمی بدهیم.

انتقال به کشورهای دیگر

سرورهای این سرویس‌ها ممکن است بیرون از ترکیه و اتحادیه‌ی اروپا باشند، مثلاً در آمریکا. برای این انتقال‌ها از قراردادها و ضمانت‌های استانداردِ خودِ این سرویس‌ها استفاده می‌کنیم.

چقدر نگه می‌داریم

اطلاعات حساب، گفت‌وگوها و عکس‌ها تا وقتی حسابت باز است نگه داشته می‌شوند. اگر درخواست حذف بدهی، حداکثر تا ۳۰ روز همه‌چیز پاک می‌شود، مگر چیزی که قانون نگه‌داشتنش را لازم بداند. پاسخ‌های کوییز سلیقه فقط روی دستگاه خودت ذخیره می‌شود.

حقوق تو

حق داری بدانی چه اطلاعاتی از تو داریم و یک نسخه از آن بگیری، اشتباهش را درست کنی، حذفش را بخواهی، با بخشی از پردازش مخالفت کنی یا آن را محدود کنی، و رضایتت را پس بگیری. برای هر کدام به [email protected] ایمیل بزن. حداکثر تا ۳۰ روز جواب می‌دهیم.
اگر در ترکیه هستی، طبق قانون حفاظت داده‌ی ترکیه (KVKK، ماده‌ی ۱۱) این حقوق را داری و می‌توانی به سازمان حفاظت داده‌ی ترکیه شکایت کنی. اگر در اتحادیه‌ی اروپا یا بریتانیا هستی، طبق GDPR همین حقوق را داری و می‌توانی به نهاد ناظر کشورت شکایت کنی. اگر در کالیفرنیا هستی، طبق CCPA هم همین حقوق را داری.

کوکی و حافظه‌ی مرورگر

فقط چیزهای ضروری را در مرورگرت ذخیره می‌کنیم: ورود به حساب، تم تیره یا روشن، پیشرفت کوییز، و دسترسی به نسخه‌ی پیش از راه‌اندازی. کوکی تبلیغاتی یا ردیاب نداریم.

حداقل سن

مدآپ برای افراد ۱۶ سال به بالاست. اگر بفهمیم حسابی متعلق به فرد کمتر از ۱۶ سال است، آن را حذف می‌کنیم.

امنیت

اتصال‌ها رمزنگاری می‌شوند و هر کاربر فقط به اطلاعات خودش دسترسی دارد. هیچ سیستمی کاملاً بی‌خطر نیست. اگر نشتی جدی رخ دهد، طبق قانون به تو و نهاد ناظر اطلاع می‌دهیم.

تغییر این متن

اگر این متن تغییر مهمی کند، داخل برنامه خبرت می‌کنیم. تاریخ بالای صفحه نشان می‌دهد آخرین بار کی عوض شده.

شرایط استفاده

پذیرش

با استفاده از مدآپ این شرایط و متن حریم خصوصی را قبول می‌کنی. اگر قبول نداری، لطفاً از مدآپ استفاده نکن.

حساب کاربری

باید حداقل ۱۶ سال داشته باشی. هر نفر یک حساب دارد و مسئول درستیِ اطلاعات و امنیت حساب خودش است. حسابت را به کس دیگری نده.

استایلیست هوشمند

پیشنهادها فقط پیشنهاد سبک و سلیقه‌اند، نه مشاوره‌ی پزشکی، روان‌شناسی یا مالی. هوش مصنوعی ممکن است اشتباه کند و تصمیم نهایی با خودت است.

پیام رایگان

هر کاربر تعداد محدودی پیام رایگان با استایلیست دارد. کوییزها رایگان‌اند. ممکن است سقف یا قیمت‌ها را بعداً تغییر دهیم و پیش از آن اطلاع می‌دهیم.

خرید بسته‌ی پیام

بعد از پیام‌های رایگان می‌توانی بسته‌ی پیام بخری. قیمت و تعداد پیام هر بسته پیش از پرداخت نشان داده می‌شود. پرداخت یک‌باره است و اشتراک یا تمدید خودکار ندارد.
فروش را Lemon Squeezy به‌عنوان «فروشنده‌ی رسمی» (Merchant of Record) انجام می‌دهد: پرداخت، مالیات و فاکتور با آن‌هاست و شرایط خرید آن‌ها هم برای پرداخت اعمال می‌شود.
پیام‌های خریده‌شده تا وقتی حسابت باز است تاریخ انقضا ندارند، به حساب دیگری منتقل نمی‌شوند و پول نقد نیستند. پیامی که استایلیست به آن جواب نداده (خطا) از بسته کم نمی‌شود.

بازگشت پول

اگر از بسته‌ای که خریده‌ای هیچ پیامی استفاده نکرده باشی، تا ۱۴ روز بعد از خرید کل پولت را پس می‌دهیم. فقط کافی است به [email protected] ایمیل بزنی.
اگر مشکلی فنی باعث شد نتوانی از پیام‌هایت استفاده کنی، به ما بنویس تا پیام‌ها را برگردانیم یا پولت را پس بدهیم.
پیش از حذف حساب، اگر بسته‌ی استفاده‌نشده داری، اول بازگشت پولش را بخواه؛ با حذف حساب پیام‌های باقی‌مانده هم پاک می‌شوند.
هیچ‌چیز در این بند حقوقی را که قانون کشورت به‌عنوان مصرف‌کننده به تو می‌دهد کم نمی‌کند.

لینک‌ها و فروشگاه‌های دیگر

اگر استایلیست لینک خرید پیشنهاد کند، آن فروشگاه‌ها مال مدآپ نیستند. مدآپ مسئول قیمت، موجودی، کیفیت یا ارسال آن‌ها نیست. پیش از خرید خودت بررسی کن.

محتوای تو

عکس‌ها و متن‌هایی که می‌فرستی مال خودت می‌مانند. به مدآپ فقط اجازه می‌دهی برای ارائه‌ی همین سرویس آن‌ها را ذخیره و پردازش کند. باید حق فرستادن آن‌ها را داشته باشی.

مالکیت مدآپ

نام، لوگو، طراحی، کوییزها و متن‌های مدآپ متعلق به مدآپ است. بدون اجازه کپی یا استفاده‌ی تجاری نکن.

تعلیق حساب

اگر قوانین محتوا یا این شرایط را زیر پا بگذاری، می‌توانیم حسابت را محدود، تعلیق یا حذف کنیم. خودت هم هر وقت بخواهی می‌توانی با ایمیل حذف حسابت را بخواهی.

مسئولیت

مدآپ «همان‌طور که هست» ارائه می‌شود. تا جایی که قانون اجازه می‌دهد، مدآپ مسئول خسارت غیرمستقیم ناشی از استفاده از پیشنهادها نیست. هیچ‌چیز در این متن حقوقی را که قانون کشورت به‌عنوان مصرف‌کننده به تو می‌دهد از بین نمی‌برد.

قانون حاکم

این شرایط تابع قوانین جمهوری ترکیه است و دادگاه‌های صالح ترکیه به اختلاف‌ها رسیدگی می‌کنند. اگر مصرف‌کننده‌ای در کشور دیگری هستی، حقوق قانونی کشور خودت هم سر جایش می‌ماند. پیش از هر اقدامی، به [email protected] بنویس تا با هم حلش کنیم.

تغییر شرایط

اگر شرایط تغییر مهمی کند، داخل برنامه اطلاع می‌دهیم. ادامه‌ی استفاده بعد از تغییر یعنی شرایط جدید را قبول کرده‌ای.

قوانین محتوا

ممنوع است

عکس برهنه یا جنسی، و هر عکسی از افراد زیر ۱۸ سال در حالت نامناسب.
عکس یا اطلاعات کس دیگری بدون اجازه‌ی او.
آزار، تهدید، نفرت‌پراکنی یا تحقیر به خاطر بدن، نژاد، دین، جنسیت یا گرایش.
جعل هویت یا ساختن حساب جعلی.
تلاش برای دور زدن سقف پیام، هک، یا استفاده‌ی خودکار و انبوه.
هر کار غیرقانونی.

احترام به بدن

مدآپ برای کمک به حس بهتر درباره‌ی استایل است. استایلیست درباره‌ی بدن هیچ‌کس قضاوت تحقیرآمیز نمی‌کند و ما هم از کاربران همین را می‌خواهیم.

گزارش

اگر محتوا یا رفتار نامناسبی دیدی، یا فکر می‌کنی کسی عکس تو را بدون اجازه فرستاده، به [email protected] ایمیل بزن. بررسی می‌کنیم و در صورت لزوم محتوا یا حساب را حذف می‌کنیم.

پیامد تخلف

بسته به شدت تخلف: هشدار، حذف محتوا، تعلیق یا حذف دائمی حساب. محتوای سوءاستفاده‌ی جنسی از کودکان را بی‌درنگ حذف و به مقامات گزارش می‌کنیم.

Privacy

Who runs ModeUp

ModeUp (modeup.co) is run by its founder, Farnoosh Khani, an individual based in Turkey, who is the data controller for your information. Questions or requests about your data: [email protected]

What we collect

Account details: name, email and Google ID when you sign in with Google, your username, and your Instagram handle if you choose to give it.
Your quiz answers, results and the style choices you make.
Messages you send to the AI stylist and photos you upload (clothes, outfits or yourself).
What the stylist remembers about your taste from your conversations.
Your phone number, only if you sign in with a phone (WhatsApp code) in the future.
Technical data: device and browser type, IP address and usage times.

How we use it

To run the service itself: create your account, show your quiz results and give you personal style suggestions.
To keep the service secure, prevent abuse and apply the free message limit.
We do not sell your data, we do not use it for targeted advertising, and we have no advertising trackers.

Legal basis

Most processing is needed to provide the service you asked for (contract). Photos of yourself and your phone number are processed only with your explicit consent, which you can withdraw at any time. Keeping the service secure is based on legitimate interest.

Your photos

Photos are used only to analyse clothes and style and answer that request. We do not use them to recognise faces or identify anyone, and we do not use them to train AI models ourselves. Do not upload someone else's photo without their permission.

Artificial intelligence

The ModeUp stylist is an AI, not a human. To reply, your messages and photos are sent through OpenRouter to an AI model (for example from OpenAI or Google). Replies can be wrong. The final decision is always yours.

Who we share it with

Only the services that run ModeUp, and only what they need:
Supabase: database, sign-in and photo storage
Cloudflare: website hosting and security
OpenRouter and model providers (OpenAI, Google): generating replies and analysing photos
Serper: finding shopping links, search text only, without your identity
Lemon Squeezy: payment and invoices for message packs. ModeUp never sees your card details
Google: Google sign-in
Resend: sending email
Twilio and Meta (WhatsApp): sending sign-in codes, only once phone sign-in is available
We may disclose data to authorities if the law requires it.

International transfers

These services may store data outside Turkey and the EU, for example in the United States. We rely on these providers' standard contractual safeguards for such transfers.

How long we keep it

Account data, conversations and photos are kept while your account is open. If you ask us to delete them, everything is erased within 30 days, except anything the law requires us to keep. Taste quiz answers are stored only on your own device.

Your rights

You can ask what data we hold about you and get a copy, correct it, have it deleted, object to or restrict some processing, and withdraw consent. Email [email protected] for any of these. We reply within 30 days.
In Turkey you have these rights under the Personal Data Protection Law (KVKK, Article 11) and can complain to the Turkish Personal Data Protection Authority. In the EU or UK you have them under the GDPR and can complain to your national supervisory authority. California residents have the same rights under the CCPA.

Cookies and browser storage

We only store what is essential in your browser: your sign-in, dark or light theme, quiz progress, and pre-launch access. We use no advertising or tracking cookies.

Minimum age

ModeUp is for people aged 16 and over. If we learn an account belongs to someone under 16, we delete it.

Security

Connections are encrypted and each user can only access their own data. No system is completely safe. If a serious breach happens, we will notify you and the authorities as the law requires.

Changes to this policy

If this policy changes in an important way, we will tell you in the app. The date at the top shows when it last changed.

Terms

Agreement

By using ModeUp you accept these terms and the privacy policy. If you do not agree, please do not use ModeUp.

Your account

You must be at least 16. Each person has one account and is responsible for their information and keeping their account secure. Do not share your account.

The AI stylist

Suggestions are style and taste ideas only, not medical, psychological or financial advice. The AI can make mistakes and the final decision is yours.

Free messages

Each user has a limited number of free stylist messages. Quizzes are free. We may change limits or prices later and will tell you before we do.

Buying message packs

After your free messages you can buy a message pack. The price and number of messages in each pack are shown before you pay. It is a one-time payment, with no subscription or automatic renewal.
Sales are handled by Lemon Squeezy as Merchant of Record: payment, tax and invoices are theirs, and their buyer terms also apply to the payment.
Purchased messages do not expire while your account is open, cannot be transferred to another account and are not cash. A message the stylist failed to answer (an error) is not taken from your pack.

Refunds

If you have not used any message from a pack you bought, we refund it in full within 14 days of purchase. Just email [email protected].
If a technical problem stops you from using your messages, write to us and we will restore the messages or refund you.
Before deleting your account, ask for a refund of any unused pack first; deleting the account also deletes the remaining messages.
Nothing in this section reduces the rights you have as a consumer under the law of your country.

Links and other shops

If the stylist suggests shopping links, those shops do not belong to ModeUp. ModeUp is not responsible for their prices, stock, quality or delivery. Check before you buy.

Your content

Photos and text you send remain yours. You only allow ModeUp to store and process them to provide this service. You must have the right to send them.

ModeUp's property

ModeUp's name, logo, design, quizzes and text belong to ModeUp. Do not copy them or use them commercially without permission.

Suspension

If you break the content rules or these terms, we can limit, suspend or delete your account. You can ask us to delete your account at any time by email.

Liability

ModeUp is provided "as is". As far as the law allows, ModeUp is not liable for indirect losses from using its suggestions. Nothing here removes rights you have as a consumer under the law of your country.

Governing law

These terms are governed by the laws of the Republic of Turkey and disputes go to the competent Turkish courts. If you are a consumer in another country, your own country's mandatory legal rights still apply. Before taking any action, please write to [email protected] so we can try to solve it together.

Changes to the terms

If the terms change in an important way, we will tell you in the app. Continuing to use ModeUp after a change means you accept the new terms.

Content rules

Not allowed

Nude or sexual images, and any inappropriate image of anyone under 18.
Photos or personal details of someone else without their permission.
Harassment, threats, hate, or shaming anyone for their body, race, religion, gender or orientation.
Impersonation or fake accounts.
Trying to get around the message limit, hacking, or automated bulk use.
Anything illegal.

Respect for bodies

ModeUp is here to help you feel better about your style. The stylist never judges anyone's body in a degrading way, and we ask the same of every user.

Reporting

If you see inappropriate content or behaviour, or think someone uploaded your photo without permission, email [email protected]. We will review it and remove content or accounts when needed.

Consequences

Depending on how serious it is: a warning, content removal, suspension or permanent account deletion. Child sexual abuse material is removed immediately and reported to the authorities.
